Criminal Law

Your rights are important. Everyone deserves someone who will tell their side of the story and get them the justice they deserve. THE JAMES FIRM, PLLC represents clients in FederalStateJustice and Traffic Courts throughout New York. We possess the knowledge, experience and skill to aggressively defend the accused. A criminal charge is just an accusation, you are innocent until you admit guilt or are proven guilty.

Criminal Law

Being arrested and charged with a criminal offense can be one of the most traumatic experiences of a person’s life. Former Suffolk County Assistant District Attorney LaToya James offers her clients access to her two decades of combined  experience both as a prosecutor and as a defense attorney.

Whether you are charged with a murder or a misdemeanor, Ms. James has the legal prowess to guide you through the entire process from arraignment to resolution.

Traffic/Parking Violations

If you are issued a ticket for a non-criminal moving traffic violation, parking ticket or red light camera citations, in the five western Suffolk County Towns and not in an incorporated village, it will be handled by Suffolk County Traffic & Parking Violations Agency (TPVA).

If you plead not guilty to a traffic ticket in the TPVA jurisdictions, your case will be heard by a Judicial Hearing Officer (JHO), an experienced judge with special training in the Vehicle and Traffic Law. A JHO has the authority to decide whether or not you are guilty and to set a fine if you are found guilty. A JHO also has the authority to revoke or suspend your driver’s license and/or auto registration when required by law or when the JHO believes it is in the interest of traffic safety. Just as in traffic courts in other areas of the state, you may present witnesses and evidence at a hearing before an JHO and be represented by your attorney.

Failure to respond by payment deadlines may result in increased fines and/or license suspension. Driving with a suspended license is a crime. A felony conviction may result in fines of up to $5,000, jail, probation, or confiscation of your vehicle.
